Release of Liability and Assumption of Risk

IN CONSIDERATION of being permitted to participate in any activities sponsored by FlowState.Studio (including its directors, officers, agents, employees, DJs, dance instructors, and volunteers) (“the FlowState.Studio Sponsors”), I agree to these terms:

I am Acknowledging and Assuming All Risk

I acknowledge that the Event involves risks of serious injury or death and property damage or loss. For example, risks relate to COVID (and other infectious disease), dance floors, dance classes, dancing, lifts or aerials, collision, physical contact, physical exertion, exhaustion, slipping, falling, dehydration, and actions of other people including but not limited to participants, volunteers, instructors, and/or FlowState.Studio staff. I understand that risks may be unanticipated or unknown.

I HAVE HAD THE OPPORTUNITY TO FULLY CONSIDER THE RISKS, AND I HEREBY ASSUME FULL RESPONSIBILITY FOR ALL OF THE RISKS OF PARTICIPATING AND/OR VOLUNTEERING IN THE EVENT, INCLUDING BUT NOT LIMITED TO ANY DEATH, LOSS, DAMAGE, OR INJURY OCCURRING IN CONNECTION WITH THE EVENT, WHETHER OR NOT CAUSED BY ANY NEGLIGENCE OF THE FLOWSTATE.STUDIO SPONSORS.

I am Releasing the FlowState.Studio Sponsors from Liability

I HEREBY WAIVE AND DISCHARGE ANY CLAIMS OR DEMANDS, COVENANT NOT TO SUE, AND RELEASE THE FLOWSTATE.STUDIO SPONSORS FROM ALL LIABILITY TO ME, MY PERSONAL REPRESENTATIVES, EXECUTORS, ASSIGNS, SUCCESSORS, HEIRS, AND NEXT OF KIN, FOR ANY LOSS, DAMAGE, INJURY, OR DEATH ARISING OUT OF OR RELATED TO THE EVENT, WHETHER OR NOT CAUSED BY ANY NEGLIGENCE OF FLOWSTATE.STUDIO SPONSORS.

I Will Indemnify the FlowState.Studio Sponsors for My Actions

I AGREE TO INDEMNIFY THE FLOWSTATE.STUDIO SPONSORS FROM ANY LOSS, LIABILITY, DAMAGE, OR COST THEY MAY INCUR AS A RESULT OF MY ACTIONS OR PARTICIPATION IN THE EVENT, WHETHER OR NOT RELATED TO ANY NEGLIGENCE OF THE FLOWSTATE.STUDIO SPONSORS, including without limitation any charges for damaging equipment or facilities, and any costs or claims for injuring other individuals.

I UNDERSTAND THAT THIS IS A LEGAL DOCUMENT AND THAT BY SIGNING IT I AM GIVING UP SOME RIGHTS TO SUE THE FLOWSTATE.STUDIO SPONSORS. I recognize that if I have any questions regarding my release of rights, I should consult an attorney.

I HAVE READ THE TERMS ABOVE, AND I FULLY UNDERSTAND THEM. I agree to participate in FlowState.Studio events knowing the risks and conditions involved and I am signing this Agreement entirely of my own free will. I affirm that I am at least 18 years of age. If the Event participant is under 18 years of age, I am the minor participant’s legal guardian and I am signing this release on his or her behalf.
